Terms and Conditions
IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS (“TERMS AND CONDITIONS”) BEFORE ENTERING THE COMPETITION. THIS IS A LEGALLY BINDING AGREEMENT BETWEEN YOU AND ASEAN FOUNDATION IN PARTNERSHIP WITH MICROSOFT AND EMPIRE CODE EDUCATION CENTRE (“EMPIRE CODE”) ESTABLISHING THE TERMS AND CONDITIONS UNDER WHICH YOU ARE ENTITLED TO PARTICIPATE IN THE COMPETITION. BY ENTERING THE COMPETITION, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD, AND AGREE TO ABIDE BY, THESE TERMS AND CONDITIONS.
About the Competition
In partnership with Microsoft and Empire Code Education Centre, the Future Ready ASEAN Competition 2019 aims to empower our next generation to take the pilot seat in technology, encouraging youth to be creators, not just consumers of tech. The competition is about enabling youth to build their foundation in computer science while taking a step at becoming a social entrepreneur.

Employees and independent contractors of the Government (including education) must adhere to gift and ethics policies applicable to them when entering the Competition or accepting any prize.

These Terms and Conditions (“Terms and Conditions”) govern the operation of the Future Ready ASEAN Competition 2019 (“Competition”). ASEAN Foundation registered in Indonesia is the Competition Sponsor (“Sponsor”).
In these Terms and Conditions, “ASEAN Foundation”, "we", "our", and "us" refer to Sponsor and “you” and "yourself" refers to a Competition participant, or the parent/legal guardian of any minor Competition entrant. By entering you (your parent/legal guardian if you are a minor) agree to be bound by these Terms and Conditions.
Entries can be submitted from now until 13 October 2019 at 11:59 PM Jakarta time (“Entry Period”). After this date no further entries will be permitted.
To be eligible:
- You must be an ASEAN youth national aged 15 to 35 years old; if aged below 18, you must have consent of a parent or legal guardian to participate. Formal parent or legal guardian consents will be requested for participants under the age of 21;
- You must be a national of one of those countries in ASEAN: Brunei, Cambodia, Indonesia, Laos, Malaysia, Myanmar (Burma), the Philippines, Singapore, Thailand, and Viet Nam.
- Employees and directors of the Sponsor and its subsidiaries, affiliates, advertising agencies, and Competition Parties are not eligible, nor are persons involved in the execution or administration of this Competition, or the family members of each above (parents, children, siblings, spouse/domestic partners, or individuals residing in the same household).

Participants will need to create a Blog Site on Sustainability and describe in their blog on how to design, build or test a prototype solution to address this challenge. Participants must identify a pressing challenge in the ASEAN region across one of the four following sub-themes:
In terms of tools required to enter the Competition, participants need to have access to a computer connected to the Internet. Participants are to download the Microsoft Visual Studio Code editor and submissions are to be coded in HTML5 and CSS. No prior computer science experience is required as students may take guidance from the Digital Citizen track of the Future Ready ASEAN website.
There is no entry fee and no purchase necessary to enter this competition. Entries need to be submitted by teams of 2, not individuals. Teams require 1 mentor. A mentor may manage more than 1 team. Only one entry will be accepted per team.
All participants and mentors are to complete and obtain the following courses on Future Ready ASEAN website:
Digital Citizen advanced level badge (blue belt)
Dream Team Player beginner level badge (yellow belt)
Data Wizard beginner level badge (yellow belt)

Acknowledge the Terms & Conditions
By entering this Competition, an entrant is indicating his/her agreement to be bound by all terms and conditions stated under these Terms and Conditions. The entry limit is one per person per team of two participants and one mentor overall. We are not responsible for excess, lost, late, or incomplete entries. If disputed, entries will be deemed submitted by the authorized account holder of the email address, social media account, or other method used to enter.
To be eligible, an entry must meet the following content / technical requirements:
- Your entry must be your own original work; and
- Your entry cannot have been selected as a winner in any other Competition; and
- You must have obtained all consents, approvals, or licenses required for you to submit your entry; and
- To the extent that entry requires the submission of user-generated Competition such as software, photos, videos, music, artwork, essays, etc., entrants warrant that their entry is their original work, has not been copied from others without permission or apparent rights, and does not violate the privacy, intellectual property rights, or other rights of any other person or entity. You may include Microsoft and Empire Code trademarks, logos, and designs, for which Microsoft and Empire Code grants you a limited license to use for the sole purposes of submitting an entry into this Competition; and
- our entry may NOT contain, as determined by us in our sole and absolute discretion, any content that is obscene or offensive, violent, defamatory, disparaging or illegal, or that promotes alcohol, illegal drugs, tobacco or a particular political agenda, or that communicates messages that may reflect negatively on the goodwill of Microsoft and Empire Code.
We are not claiming ownership rights to your Submission. However, by submitting an entry, you grant us an irrevocable, royalty-free, worldwide right and license to use, review, assess, test and otherwise analyze your entry and all its content in connection with this Competition and use your entry in any media whatsoever now known or later invented for any non-commercial or commercial purpose, including, but not limited to, the marketing, sale or promotion of the Sponsor’s, Microsoft’s and Lenovo’s products or services, without further permission from you. You will not receive any compensation or credit for use of your entry, other than what is described in these Terms and Conditions. You consent to us doing (or omitting to do) any acts in respect of your entry which may otherwise constitute an infringement of your moral rights.
By entering you acknowledge that we may have developed or commissioned materials similar or identical to your entry and you waive any claims resulting from any similarities to your entry. Further you understand that we will not restrict work assignments of representatives who have had access to your entry and you agree that use of information in our representatives’ unaided memories in the development or deployment of our products or services does not create liability for us under this agreement or copyright or trade secret law.
Your entry may be posted on a public website. We are not responsible for any unauthorized use of your entry by visitors to this website. We are not obligated to use your entry for any purpose, even if it has been selected as a winning entry.
Pending confirmation of eligibility, potential finalists are to join the final competition on 28 to 29 November 2019 in Bangkok, Thailand. Finalists will be selected from among all eligible entries received by a qualified judging panel. The promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
The judging panel will evaluate the entries based on these weighted criteria:
Theme (30%) - The sustainable goal chosen and content
Blog Site Appeal (30%) - User experience, user interface, visual aspects
Codes (30%) - Use of HTML5 and CSS on Microsoft Visual Studio Code mandatory. Proper file management and organization.
Instructions (10%) - Ability to take competition requirement instructions
Inclusion of skills learnt through other learning tracks is a plus.We will announce the finalists before 15 November 2019. The Sponsor will notify each winner via email.
In the event of a tie between any eligible entries, an additional judge will break the tie based on the judging criteria described above. The decisions of the judges are final and binding. If we do not receive a sufficient number of entries meeting the entry requirements, we may, at our discretion, select fewer winners than the number of Competition Prizes described below. If public vote determines winners, it is prohibited for any person to obtain votes by any fraudulent or inappropriate means, including offering prizes or other inducements in exchange for votes, automated programs or fraudulent i.d’s. ASEAN Foundation, Microsoft and Empire Code will void any questionable votes.
Winners will be announced during the finals in Bangkok on 29 November 2019. For prize collections, if a selected winner cannot be contacted, is ineligible, fails to claim a prize or fails to return any forms within 7 days, the selected winner will forfeit their eligibility to join the competition finals, and an alternate winner will be selected in the time allowing. If you are a potential winner and you are 18 years of age or older, but are considered a minor in your place of legal residence, we may require your parent or legal guardian to sign all required forms on your behalf.
The following prizes will be awarded to the top three winners during the finals:

Certificates will be provided for Finalists and Participants who meet the competition requirements.
Participants receiving a Certificate of Participation will receive a soft copy to be sent by email by the Sponsor.
The ARV of prizes is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Terms and Conditions and the date the prize is awarded or redeemed. We will determine the value of the prize to be the fair market value at the time of prize award.
The total Approximate Retail Value (ARV) of all prizes: 4,500 USD (United States Dollar).
We will only award three (3) prizes during the Entry Period. No more than the stated number of prizes will be awarded. One single person can only win one prize. No substitution, transfer, or assignment of prize permitted, except that the Sponsor reserves the right to substitute a prize of equal or greater value in the event the offered prize is unavailable.
Prizes will be sent no later than 28 days after the finals. The winner is responsible for theirown tex of this prize since ASEAN Foundation is not subjected to tax.
Prizes must be claimed by March 30, 2020 or the prize will be forfeited. In the event the winner does not take an element of the prize at the time stipulated by the Sponsor, then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
The Sponsor accepts no responsibility for prizes damaged or lost in transit.
By accepting a prize, you agree that the Sponsor may use your entry, name, image and other details online and in print, or in any other media, in connection with this Competition without payment or compensation to you, except where prohibited by law.
To the maximum extent allowed by law, by entering you agree to release and hold harmless the Sponsor and its respective parents, partners, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or any damage, loss, death or personal injury that may occur as a result of your participation in the Competition. You undertake to indemnify and keep the Sponsor and its respective parents, partners, subsidiaries, affiliates, directors, officers, employees and agents harmless and indemnified against any loss, damage, claims, costs and expenses which may be incurred or suffered by each or any of them due to your breach of any of these Terms and Conditions and/or arising from your participation in the Competition.
All local laws apply. The decisions of the Sponsor are final and binding.
We reserve the right to cancel, change or suspend this Competition for any reason, including cheating, technology failure, catastrophe, war or any other unforeseen or unexpected event that affects the integrity of this Competition, whether human or mechanical. If the integrity of the Competition cannot be restored, we may select winners from among all eligible entries received before we had to cancel, change or suspend the Competition. Violators will be prosecuted to the full extent of the law and may be banned from participation in future Competitions.
Details from all entries will be collected and used for the purposes of conducting this Competition (which may include disclosure to third parties for the purpose of processing and conducting the Competition) and for publicity purposes surrounding this Competition. The information submitted by you during the registration process or otherwise when participating in the Competition may include your full name, email address, date of birth, country of residence and other personal information (“Personal Information”) . To authenticate your age and country of residence, the Sponsor reserves the right to ask for identifying documents such as a birth certificate or an identification card before any prize(s) can be delivered to you. This is only to ensure participants are in accordance with the rules of the Competition.
The winner agrees to the use of his/her name and image in any publicity material, as well as their entry. Any personal data relating to the winner or any other entrants will be used solely in accordance with current Asia Pacific data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
Taxes and other levies imposed by any relevant applicable government or tax authority, as well as other costs including insurance and incidental costs, that may be levied or incurred on the prizes shall be fully borne by the prize winner.
To the maximum extent permitted by law:
a. The Sponsor and its agents or contractors (if any) that it may use in the execution and management of the Competition do not warrant or represent (either directly or indirectly): a. That participation in and/or access to the whole or any part of the Competition, Competition materials, content, information and/or functions contained in them will be provided on an uninterrupted, timely, secure and error-free basis; or b. That no computer viruses shall be transmitted or that no damage shall occur to your computer system as a result of any online activity of the Competition (if any).
b. Any material downloaded or otherwise obtained through the Internet is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data resulting from such download.
c. The Sponsor does not warrant or make any representations regarding the use, validity, accuracy, or reliability of, or the results of the use of, or otherwise in respect of the materials on the Competition site or any sites linked to the Competition site.
You acknowledge and agree that no form of cheating will be tolerated. If you are found cheating, as determined in the sole and absolute discretion of the Sponsor, you will immediately be disqualified from the Competition. Cheating includes, but is not limited to, using multiple identification numbers, tampering with, hacking of the Competition site (if any), participating in the Competition without meeting the eligibility requirements, using any automated software or device to gain an advantage during the Competition, use of the Competition beyond the defined Terms and Conditions of the Competition, attempting to disable or overwhelm any of the Sponsor’s websites or the Competition site (if any), attempting to disrupt any portion of the Competition, including but not limited to, allowing somebody else to use your Personal Information, or tampering with the entry process. ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY OF THE SPONSOR’S WEBSITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS; AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
The Sponsor’s failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that or of any other provision.
To the maximum extent permitted by law, the Sponsor may modify these Terms and Conditions and/or withdraw or terminate the Competition at any stage without libility towards anyone.
This Competition will be governed by the laws of Indonesia, and you consent to the exclusive jurisdiction and venue of the courts of Indonesia for any disputes arising out of this Competition. The Competition is void where prohibited or restricted by law, and is subject to all applicable laws.
A person who is not a party to this agreement shall not have any rights under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of its terms. For the purposes of this paragraph, “person” shall mean a human being or a corporate entity (whether or not having a separate legal personality), as the case may be.
